Welcome to www.vallon.com (the “Site”). These Terms of Service (“Terms”) govern your use of the Site and purchases from VALLON B.V. (“VALLON,” “we,” “us,” or “our”). By accessing the Site and/or purchasing from us, you agree to these Terms and our Privacy Policy.
OVERVIEW
This Site is operated by VALLON B.V.. By visiting the Site and/or purchasing from us, you engage in our “Service” and agree to be bound by these Terms, including policies referenced here or available by hyperlink. These Terms apply to all users of the Site.
We may update these Terms from time to time by posting a new version on the Site. Your continued use of the Site following any changes constitutes acceptance of the updated Terms.
ONLINE STORE TERMS
By using the Site, you represent that you are at least the age of majority in your place of residence, or that you have the consent of your parent/guardian for any minor dependents who use the Site.
You agree not to use our products for any illegal or unauthorized purpose and not to violate any applicable laws, including intellectual property laws. You must not transmit worms, viruses, or any code of a destructive nature. A breach of these Terms may result in immediate termination of your access to the Service.
DISCOUNT CODES
By submitting your email you may receive discount codes that can be applied at checkout, subject to the following:

Codes cannot be combined with other discounts or products already on sale.

Newsletter 10% codes: valid for 7 days from receipt and require a minimum order value of €40 / $45.

Additional code-specific terms may apply as shown at issuance.
We reserve the right to decline or cancel orders where a code was obtained or used fraudulently or in breach of these Terms.
PRICING AND PAYMENT
Prices, taxes, and shipping fees are displayed at checkout and may change without notice. We accept Shopify Payments (Shop Pay), PayPal, and any other methods shown at checkout. By submitting payment, you confirm you’re authorized to use the selected method. We may refuse or cancel orders (e.g., suspected fraud, pricing errors, inventory issues).
SHIPPING, DELIVERY & RISK OF LOSS
Orders are processed according to the shipping option selected at checkout. Delivery timelines are estimates and not guarantees. Risk of loss and title pass to you upon delivery to the address provided or to the carrier where applicable by law.
Undelivered Items with Express Shipping: If you select an express service and the parcel is undelivered because the recipient was unavailable, the express surcharge is non-refundable.
RETURNS & REFUNDS — NON-PRESCRIPTION PRODUCTS
We want you to love your VALLONs. You may return non-prescription products within 30 days of purchase, subject to the conditions below. Free returns* are available for orders from the EU, USA, Canada, Switzerland, Norway, and the UK.
Condition of Items: Returned items must be unused, unaltered, undamaged, and include all original packaging and tags. Returns missing packaging may incur a fee.
Refund Method: Refunds are issued to the original payment method only (e.g., the same card or PayPal account). Processing times vary by bank.
Exchange / Store Credit: You may choose a replacement item or store credit instead of a refund.
* Free returns apply only when (a) the return value is above €40 / $45 and (b) you register the return via our Return Portals. If you ship an item back at your own expense, it will not be reimbursed. If your return value is below the threshold, contact support@vallon.store for assistance.
Your statutory rights (including any mandatory cooling-off period in the EU/UK) are not affected.
RETURNS — RX (PRESCRIPTION) PRODUCTS
Custom Rx products cannot be returned except as outlined below and in accordance with applicable consumer laws.

Ophthalmology Error (Doctor’s Prescription): If your eye doctor’s prescription was incorrect and you must repeat the exam, we offer a 50% discount on a reorder.

VALLON Error (Manufacturing): If you suspect a lens or manufacturing fault, please have your eye doctor/optician review our work and contact us. If a defect is confirmed (e.g., materials issue or lenses not made to the prescription provided), we will remake your prescription at no cost and cover shipping both ways.
Contact support@vallon.store within 30 days of receipt, include your order number, description of the issue, and photos or documentation. Requests are assessed case-by-case.
STORE CREDIT & GIFT CARDS
If you pay with store credit/gift cards and your purchase is lower than your credit, the balance remains available for future orders (not redeemable for cash). Returns of purchases made with store credit/gift cards are refunded back to the same gift card.
Store Credit from Returns: If you opted for a gift card (store credit) when registering your return, you may request a cash refund to the original payment method within 14 days of gift card issuance. If you used that gift card on a new order and then return the second order for a cash refund, we will issue the refund to your original payment method minus a €10 handling fee.
WARRANTY — NON-PRESCRIPTION PRODUCTS
For purchases before 1 November 2023, a 2-year warranty from the date of purchase applies. For purchases on/after 1 November 2023, we offer a lifetime warranty to the original purchaser with proof of purchase from vallon.com.
Covered:

Manufacturing defects in frames, lenses, temples, straps, or screws.

Products arriving with marks, scratches, or discoloration (must notify us immediately with photos).
Not Covered:
-
Normal wear and tear (including lens scratches or strap degradation).

Damage from improper use/storage, neglect, accident, solvents/chemicals (e.g., sunscreen, hairspray, alcohol), saltwater/pool chemicals.

Heat damage/melting; fogging due to perspiration; lens degradation/delamination from chemicals/saltwater.

Lost or stolen goods after delivery (orders marked “Delivered” are considered complete).

Items altered or fitted with third-party prescription lenses.
How to Claim: Email support@vallon.store with subject “Warranty claim”, include your name, order number, a detailed description, and clear photos of the issue. If covered under the 2-year warranty, we will provide the necessary replacement part or a prepaid label (where available; otherwise we may reimburse reasonable return costs). If the product is deemed defective, we will send a replacement free of charge. The warranty provides a replacement remedy only and not a refund (unless your statutory rights require otherwise).
WARRANTY — RX (PRESCRIPTION) PRODUCTS
VALLON Rx products include a 2-year warranty for authentic products and parts without modifications. Any alterations void the warranty. Warranty claims follow the process in Section 9.
ACCURACY OF BILLING & ACCOUNT INFORMATION
We may refuse or cancel orders at our discretion, including where we suspect fraud or reseller activity. You agree to provide current, complete, and accurate purchase and account information and to promptly update your details (email, payment method, expiration dates) so we can complete your transactions and contact you as needed.
OPTIONAL TOOLS & THIRD-PARTY LINKS
We may provide access to third-party tools or websites on an “as is” and “as available” basis. We do not monitor or control these tools or sites and are not responsible for any issues arising from their use. Third-party sites are governed by their own terms and privacy policies.
USER CONTENT (COMMENTS & FEEDBACK)
If you submit ideas, suggestions, proposals, plans, or other materials (“Comments”), you grant us a nonexclusive, worldwide, royalty-free right to use, edit, publish, translate, and distribute such Comments without obligation to compensate you or maintain confidentiality. You represent that your Comments do not infringe third-party rights, contain unlawful or harmful content, or malware. You are solely responsible for your Comments.
PERSONAL INFORMATION
Your submission of personal information through the Site is governed by our Privacy Policy (see Site footer for the current version).
ERRORS, INACCURACIES & OMISSIONS
Occasionally there may be information on the Site that contains typographical errors, inaccuracies, or omissions (e.g., product descriptions, pricing, promotions, shipping charges, transit times, and availability). We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).
PROHIBITED USES
You may not use the Site or its content, among other things: (a) for unlawful purposes; (b) to violate laws or regulations; (c) to infringe intellectual property rights; (d) to harass, defame, abuse, or discriminate; (e) to submit false or misleading information; (f) to upload malware; (g) to collect or track personal information of others; (h) to spam, phish, pharm, pretext, spider, crawl, or scrape; (i) for obscene or immoral purposes; or (j) to circumvent security features. We may terminate your use of the Service for violating any prohibited use.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. The Service and all products are provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, durability, title, and non-infringement.
To the fullest extent permitted by law, VALLON B.V. and our directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors will not be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, revenue, savings, data, or replacement costs) arising from your use of the Service or products, even if advised of the possibility. In jurisdictions that do not allow such exclusions, liability shall be limited to the maximum extent permitted by law.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless VALLON B.V. and our affiliates, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, arising from your breach of these Terms or violation of law or third-party rights.
SEVERABILITY
If any provision of these Terms is determined to be unlawful or unenforceable, that provision shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.
TERMINATION
These Terms are effective unless terminated by you or us. You may stop using the Site at any time. If we believe you have violated these Terms, we may terminate your access without notice. Obligations and liabilities incurred prior to termination survive termination.
ENTIRE AGREEMENT; NO WAIVER
These Terms and any policies posted on the Site constitute the entire agreement between you and us regarding the Service and supersede prior agreements. Our failure to enforce any right or provision is not a waiver of such right or provision.
GOVERNING LAW & JURISDICTION
These Terms and any separate agreements are governed by the laws of The Netherlands, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the competent courts of The Netherlands, unless mandatory consumer protection rules provide otherwise.
CONSUMER RIGHTS (EU/UK)
If you are a consumer in the EU/UK, you may have additional statutory rights, including a 14-day right of withdrawal for distance purchases. This right does not apply to custom-made goods (including Rx/prescription products) or goods unsealed after delivery that are not suitable for return for health/hygiene reasons if unsealed. These Terms do not limit any non-waivable consumer rights.
